While it is legal for property owners in Colorado to grow marijuana for their personal use, when buying or selling a home, consider:
• Were any modifications to plumbing or electrical systems made to accommodate the grow operation? Were they performed by a licensed contractor?
• Are there potential health, humidity or mold impacts resulting from the cultivation activity?
While there is no legal requirement to disclose marijuana use or cultivation activities, there are certain considerations that could result in future liability claims. Full and open disclosure is always the best practice, but understand that lenders and buyers might be turned off.
